Introduction

These Terms of Use govern your access to and use of the MoTHer app only and do not replace the Participant Information Sheet and Consent Form, which you will be asked to review and agree to separately.

By using this app and the content available on and through it, you are agreeing to be bound by these Terms of Use and have read and accepted the Privacy Policy.

These Terms of Use form the legally binding agreement between you and the Commonwealth Scientific and Industrial Research Organisation ABN 41 687 119 230 (CSIRO). We may amend these Terms of Use at any time. Amendments will be effective immediately upon notification in the app. Your continued use of the app following such notification represents agreement to be bound by the updated Terms of Use.

Important: This app is provided for use by participants who have consented to take part in the MoTHer research study and does not replace or constitute medical advice on your health status or medical condition. If you need medical care or require advice for any condition monitored using the MoTHer app, you must contact a health professional such as your diabetes educator, clinician, or nurse.

Registration and Termination

To use the app and upload your content, you must be a registered participant in the MoTHer program and:

When registering, you must complete a user profile including your name, date of birth, height, weight, due date, and number of weeks pregnant.

Only you may log in to and use your account. Your use of the app is for your personal, non-commercial participation in the MoTHer program only. You are responsible for maintaining the confidentiality and security of your login details and devices.

If you wish to terminate your account, contact motherapp@csiro.au and delete the app from your device(s). Choosing not to consent, or withdrawing consent, will not affect the clinical care you receive.

We may lock, restrict, suspend, or terminate your account if you breach these Terms of Use.

User Data

The collection and use of your data for research purposes is described in the Participant Information Sheet and Consent Form. These Terms of Use describe how the app operates and how data is managed within the app.

You retain copyright and any other rights you already hold in your content. By submitting your content through the app, you agree that CSIRO may use, reproduce, adapt, modify or sub-license it for any purpose, although your personal information will be managed as described in the Privacy Policy.

You acknowledge that CSIRO may publish a de-identified version of your content in reports, papers, and publications, and allow research collaborators to use the de-identified content for research, education, or training purposes.

Using the App and App Content

You may use the app and app content only for lawful purposes, in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the app by any third party. You must not post or transmit material which:

Intellectual Property

All intellectual property rights in this app, including design, text, graphics, video, logos, icons, sound recordings and all software, belong to or are licensed by CSIRO. These rights are protected by Australian and international laws.

You may not copy, adapt, reproduce, store, modify, distribute, publish, or create derivative works from any part of this app without prior written permission from CSIRO.

Notifications

The app may display or send notifications including health messages, surveys, and information via in-app notifications, SMS, or email. You can manage notification preferences through your phone settings or the app settings page. Turning off notifications may limit your access to some components of care.

Links to External Websites

The app may include links to external websites. CSIRO does not control the content of linked websites and is not responsible for their content or privacy practices. Links do not constitute an endorsement by CSIRO.

Security

Your personal and health information is stored on Google Cloud Platform servers in Australia, protected and accessible only to authorised personnel. Data security is managed through firewalls, encryption of private data, and separation of access privileges.

You must not try to circumvent the security features of the app, or tamper with, hack into, or otherwise disrupt any system used to host or make the app available.

Disclaimer

The app and app content are provided ‘as is’ and ‘as available’. CSIRO gives no warranty regarding the quality, accuracy, completeness, currency, relevance, or suitability for any particular purpose of the app or its content.

To the fullest extent permitted by applicable law, CSIRO excludes all liability for any consequences arising directly or indirectly from your use of the app or inability to access it, including all losses, damages, costs, expenses, and any other compensation.

Applicable Law

These Terms of Use are governed by the law applicable to the Australian Capital Territory and the parties submit to the non-exclusive jurisdiction of the courts of that territory.

Modification

CSIRO reserves the right at any time to modify or cease, temporarily or permanently, the app or the MoTHer clinical portal with or without notice. You agree that CSIRO will not be liable to you or any third party for any such modification, suspension, or discontinuance.
